These Terms of Service (“Terms”) govern your use of the MomentCraft website at momentcraft.io and all related services (collectively, the “Service”) operated by MomentCraft (“we,” “our,” or “us”).

By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Description of Service

MomentCraft provides AI-powered tools for creating personalized speeches and interactive surprise reveal games. Our services include:

• AI Speech Writer: An AI-guided interview process that generates personalized speeches for occasions including eulogies, wedding toasts, retirement speeches, graduation speeches, roasts, and more.
• AI Reveal Games: Interactive digital games (crossword, word search, trivia) designed for milestone announcements including pregnancy reveals, gender reveals, bridesmaid proposals, groomsman proposals, and engagement announcements.

2. AI-Generated Content Disclaimer

All content generated by MomentCraft is created by artificial intelligence and is provided as a starting point only.

By using our Service, you acknowledge and agree that:

• AI-generated speeches and game content may contain errors, inaccuracies, or content that does not perfectly reflect your intent or the person being honored.
• You are solely responsible for reviewing, editing, and approving all generated content before use. We strongly recommend reading your entire speech aloud at least once before delivering it and reviewing all game clues before sharing.
• MomentCraft does not guarantee that AI-generated content will be appropriate for your specific situation, audience, or cultural context.
• AI models may occasionally produce unexpected, awkward, or insensitive output despite our quality controls. This is an inherent limitation of AI technology.
• MomentCraft is not responsible for any emotional distress, embarrassment, offense, damaged relationships, or other consequences resulting from the use or delivery of AI-generated content.
• The quality of generated content depends significantly on the detail and accuracy of the information you provide during the interview or input process.

You use all generated content at your own risk and discretion.

3. Eligibility

You must be at least 18 years of age to use the Service and make purchases. By using the Service, you represent that you are at least 18 years old.

4. Purchases and Payment

• All purchases are one-time payments. There are no subscriptions or recurring charges.
• Prices are listed in US Dollars (USD).
• Payment is processed securely by Stripe, Inc. MomentCraft does not store your payment card information.
• Speech pricing: Standard ($14.99), Plus ($24.99), Premium ($39.99).
• Game pricing: Standard ($6.99), Plus ($12.99), Premium ($19.99).
• Prices are subject to change. Any price changes will not affect purchases already completed.
• Sales tax may be applied where required by law.

5. Refund Policy

We offer a full refund within 7 days of purchase, no questions asked. To request a refund, email support@momentcraft.io with your purchase details. Refunds are processed back to the original payment method within 5-10 business days.

After 7 days, refunds are granted at our sole discretion.

6. Content Ownership and License

• Your inputs: You retain ownership of all information you provide during the interview process and game customization (your stories, memories, names, and personal details).
• Generated content: Upon purchase, you are granted a non-exclusive, perpetual license to use, edit, reproduce, and distribute the generated speech or game content for personal, non-commercial purposes.
• You may not: Resell, redistribute, or commercially exploit generated content. You may not use the Service to generate content in bulk for resale.
• Our rights: We retain no ownership of your generated content. We do not use your generated content for marketing, training, or any purpose other than delivering your product and providing support.

7. Content Access and Expiration

• Speech links: Accessible for 90 days from the date of purchase. After 90 days, the link expires and the content is no longer accessible. We recommend downloading or printing your speech before expiration.
• Game links: Accessible for 1 year from the date of purchase. After 1 year, the link expires and game play is no longer available.
• No recovery after expiration: Once content expires, it cannot be recovered. We are not responsible for content lost due to expiration.
• PDF copies: Speech purchase emails include a PDF attachment. We recommend saving this as a permanent backup.

8. Acceptable Use

You agree not to use the Service to:

• Generate content that is illegal, defamatory, threatening, harassing, or promotes violence
• Generate content that infringes on the intellectual property rights of others
• Generate content that impersonates another person without their knowledge or consent
• Attempt to circumvent payment requirements, reverse-engineer the Service, or access the Service through automated means (bots, scrapers)
• Exploit, overload, or interfere with the Service's infrastructure
• Share game links or speech access links publicly in a way that encourages mass unauthorized access

9. Intellectual Property

The MomentCraft name, logo, website design, showcase content, and all original written materials are the property of MomentCraft and are protected by intellectual property laws. You may not copy, reproduce, or use our branding without written permission.

10. Third-Party Services

The Service relies on third-party providers including Stripe (payment processing), Anthropic (AI content generation), Supabase (data storage), Vercel (hosting), and Resend (email delivery). We are not responsible for the availability, performance, or policies of these third-party services.

11. Limitation of Liability

To the fullest extent permitted by law:

• MomentCraft, its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
• MomentCraft shall not be liable for any damages arising from the delivery, performance, or reception of AI-generated content, including but not limited to: emotional distress, embarrassment, damaged personal or professional relationships, or missed opportunities.
• MomentCraft shall not be liable for any damages resulting from service outages, data loss, expired links, or third-party service failures.
• Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid for the specific product giving rise to the claim.

12. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free
• AI-generated content will be accurate, complete, appropriate, or suitable for your intended purpose
• The results obtained from using the Service will meet your expectations
• Any errors in the Service will be corrected

13. Indemnification

You agree to indemnify and hold harmless MomentCraft, its owners, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your delivery or distribution of AI-generated content, your violation of these Terms, or your violation of any third party's rights.

14. Dispute Resolution

Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration shall take place in the state where MomentCraft is headquartered. You agree to waive any right to a jury trial or to participate in a class action lawsuit.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the “Last updated” date at the top of this page. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
